Welcome to the website and online services of EMBAC. EMBAC is the public-facing name of the Executive MBA Council, the legal entity that operates these services. In these Terms of Use ("Terms"), we refer to the organization simply as "EMBAC," "we," "us," or "our."
These Terms govern your access to and use of EMBAC's website, member portal, online communities, research materials, directories, event registration services, and other EMBAC-controlled digital resources that link to these Terms (collectively, the "Site").
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Site.
1. About EMBAC

Certain portions of the Site are available to the public, while other resources and services may be available only to EMBAC members, event participants, research participants, or other authorized users.
2. Permitted Use
You may use the Site and its content for lawful purposes consistent with EMBAC's mission and your relationship with EMBAC.
Unless otherwise indicated, you may view, download, or print reasonable portions of publicly available EMBAC content for your own informational, educational, or non-commercial professional use.
You may not:
- Use the Site in violation of any applicable law or regulation;
- Attempt to gain unauthorized access to the Site, another user's account, or EMBAC systems;
- Interfere with the security, operation, or availability of the Site;
- Use automated tools, artificial intelligence systems, bots, crawlers, or other technologies to scrape, harvest, extract, reproduce, or collect Site content or data, including for purposes of training, developing, or improving artificial intelligence or machine-learning systems, without EMBAC's prior written permission;
- Use EMBAC content, research, data, directories, or other resources for unauthorized commercial purposes;
- Reproduce, distribute, republish, sell, license, or commercially exploit EMBAC content without authorization;

3. Member Accounts and Member-Only Resources
Certain portions of the Site may require registration, membership, or other authorization. You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.
Member-only content and resources are provided as a benefit of membership and may not be shared with unauthorized individuals or organizations unless EMBAC expressly permits such sharing.
Access to member-only resources may be modified, suspended, or discontinued when an individual's or institution's eligibility, employment, affiliation, or membership status changes.
4. EMBAC Research, Data, and Publications
EMBAC conducts research and produces reports, benchmarking information, survey results, articles, presentations, and other resources for its members and the broader executive and working-professional graduate education community.
Unless otherwise stated, EMBAC retains all rights in its research reports, analyses, publications, presentations, graphics, compilations, data, and other materials.
EMBAC research and data are provided for informational and educational purposes. While EMBAC strives to provide accurate and useful information, research findings may be based on survey responses, self-reported information, estimates, samples, and other sources that may contain limitations.
Users should exercise their own professional judgment when making decisions based on EMBAC research, data, or other Site content.
5. Intellectual Property
Unless otherwise indicated, the Site and its content—including text, research, reports, data, graphics, photographs, videos, logos, trademarks, design elements, and other materials—are owned by EMBAC or used with permission and are protected by applicable intellectual property laws.
The EMBAC name, logo, tagline, and other EMBAC marks and branding may not be used in a manner that suggests sponsorship, endorsement, membership, or affiliation without EMBAC's permission.
Nothing in these Terms transfers ownership of EMBAC intellectual property to any user.
6. Member Directory and Contact Information
EMBAC may provide authorized users with access to directories or other contact information relating to members, institutions, programs, corporate members, or other participants in the EMBAC community.
Such information is provided to facilitate professional communication, networking, collaboration, and other activities consistent with EMBAC's mission.
Directory and contact information may not be harvested, sold, transferred, reproduced in bulk, or used for unauthorized mass marketing, solicitation, or other commercial purposes inconsistent with the purpose for which access was provided.
7. User-Submitted Content
Certain areas of the Site may allow users to submit information, comments, documents, photographs, presentations, discussion posts, or other materials ("User Content").
You remain responsible for User Content you submit and represent that you have the right to provide it.
By submitting User Content for publication or sharing through EMBAC services, you grant EMBAC a non-exclusive, royalty-free right to use, reproduce, display, distribute, and adapt that content as reasonably necessary to operate the Site, provide EMBAC programs and services, and carry out the purpose for which the content was submitted.
This license will continue to the extent reasonably necessary for EMBAC to maintain, archive, or continue using materials that were published, distributed, or incorporated into EMBAC resources before the User Content was withdrawn or the user's relationship with EMBAC ended.
You should not submit confidential, proprietary, or sensitive information to public or community areas of the Site unless you are authorized to do so.
EMBAC reserves the right to remove User Content that violates these Terms or that EMBAC reasonably determines is inappropriate for its Site or community.
8. Third-Party Websites and Services
The Site may contain links to websites, platforms, products, or services operated by third parties, including EMBAC members, corporate members, strategic partners, sponsors, event providers, and technology providers.
These links are provided for convenience and informational purposes. Unless expressly stated otherwise, the presence of a link does not constitute EMBAC's endorsement or guarantee of the third party or its products, services, content, or practices.
EMBAC does not control and is not responsible for the content, availability, security, privacy practices, or other practices of third-party websites or services. Your use of third-party websites and services is subject to their respective terms and policies.
9. Privacy and Cookies
Your use of the Site is also subject to EMBAC's Privacy Policy, which describes how EMBAC collects, uses, shares, and protects personal information.
The Site may use cookies and similar technologies for purposes such as Site functionality, security, analytics, and improving the user experience. Additional information about these practices and available choices is provided through EMBAC's Privacy Policy and, where applicable, cookie notices presented through the Site.
Additional privacy notices or policies may apply to particular EMBAC programs, research activities, events, or services.
10. No Professional Advice
Information provided through the Site is intended for general informational, educational, research, networking, and professional-development purposes.
Nothing on the Site constitutes legal, financial, accounting, accreditation, regulatory, or other professional advice. Users should consult appropriate professional advisors when making decisions requiring such advice.
11. Disclaimer of Warranties
EMBAC strives to keep its Site and resources accurate, current, secure, and available. However, the Site and its content are provided on an "as is" and "as available" basis.
To the fullest extent permitted by applicable law, EMBAC disclaims all warranties, express or implied, regarding the completeness, accuracy, reliability, availability, security, merchantability, fitness for a particular purpose, or suitability of the Site or its content.
EMBAC does not warrant that access to the Site will be uninterrupted, secure, or error-free or that defects will always be corrected.
12. Limitation of Liability
To the fullest extent permitted by applicable law, EMBAC and its officers, directors, employees, contractors, volunteers, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your access to or use of, or inability to access or use, the Site or its content.
To the fullest extent permitted by applicable law, EMBAC's total aggregate liability for any claim arising out of or relating to the Site or these Terms will not exceed the amount, if any, paid by you to EMBAC for the specific Site service giving rise to the claim during the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
13. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless EMBAC and its officers, directors, employees, contractors, volunteers, and agents from claims, damages, liabilities, and reasonable expenses arising from your unlawful or unauthorized use of the Site, your violation of these Terms, your User Content, or your infringement of the rights of another person or organization.
14. Suspension or Termination of Access
EMBAC may suspend, restrict, or terminate access to all or part of the Site when reasonably necessary to protect EMBAC, its members, its systems, or other users, or when a user violates these Terms.
Termination or suspension of access does not affect provisions of these Terms that by their nature should continue to apply after access ends, including provisions concerning intellectual property, limitations of liability, and indemnification.
15. Changes to the Site or These Terms
EMBAC may update the Site, its services, or these Terms from time to time.
When these Terms are revised, EMBAC will update the "Last Updated" date shown above. Your continued use of the Site following the posting of revised Terms constitutes acceptance of the revised Terms.
When changes are material, EMBAC may also provide additional notice through the Site, member portal, email, or other reasonable means, as appropriate.
If you do not agree with revised Terms, you should discontinue use of the Site.
16. Governing Law
These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict-of-law principles, except where applicable law requires otherwise.
To the extent permitted by applicable law, any legal action or proceeding arising out of or relating to these Terms or the Site shall be brought in a state or federal court located in the State of Georgia, and you consent to the personal jurisdiction and venue of those courts.
17. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable, where permitted by law. The remaining provisions of these Terms will remain in full force and effect.
18. Waiver
EMBAC's failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. Any waiver must be expressly made by EMBAC and will apply only to the specific circumstance for which it is given.
19. Entire Agreement
These Terms, together with EMBAC's Privacy Policy and any additional terms expressly applicable to a particular EMBAC service, constitute the agreement between you and EMBAC regarding your use of the Site and supersede prior terms or agreements concerning such use.
